Armadum Lawyers successfully challenged in court illegal actions of employees of the State Customs Service of Ukraine and defended the interests of a non-resident individual

Lawyers of Armadum Lawyers successfully appealed in court against the illegal sanctions imposed by the employees of the State Customs Service of Ukraine. They were mentioned in the protocol on violation of customs rules for exceeding the term of temporary importation by a natural person of a non-resident vehicle under Part 6 of Art. 481 of the Customs Code of Ukraine (hereinafter - СCU).

In particular, the protocol on violation of customs rules was drawn up with gross violations of the rights of a person brought to administrative responsibility (Part 2 of Article 492 of the СCU, Part 5 of Article 494 of the СCU, Part 1 of Article 498 of the СCU), lack of administrative offense, disregard inspector of force majeure (breakdown of a car that was not subject to operation). In addition, the case materials were transferred to the court by the State Customs Service of Ukraine without clarifying all the circumstances of the case and without an objective assessment of violations of the provisions of current legislation by the customs inspector.

Lawyers of Armadum Lawyers submitted to the court substantiated written explanations about the illegality of the actions of employees of the State Customs Service of Ukraine, violation of the procedural procedure for drawing up a protocol on violation of customs rules and the absence of an administrative offense.

As a result of timely and coordinated actions of our lawyers, the fines imposed by the employees of the State Customs Service were lifted in court.
