Armadum Lawyers has successfully defended the interests of foreign investors in Ukraine
Armadum Lawyers' lawyers successfully appealed in court and overturned the illegal decision of the Central Interregional Department of the State Migration Service in Kyiv and Kyiv Oblast to deny immigration to Ukraine to a non-resident of Ukraine.In particular, a citizen of the Republic of Azerbaijan made a foreign investment in the economy of Ukraine in a foreign convertible currency in the amount of 100,000.00 US dollars by crediting them to the current account of a Ukrainian company. As a result, he submitted to the state authorities of Ukraine all the necessary documents in order to obtain an immigration permit to Ukraine. However, without clarifying all the circumstances of the case and without an objective assessment, it was decided to refuse to grant an immigration permit to Ukraine. As follows from the content of the refusal, the Central Interregional Department of the State Migration Service in Kyiv and Kyiv region justified its decision to refuse that the submitted certificate of crediting the current account of a Ukrainian foreign investment company does not meet the requirements of Ukrainian migration legislation. transferred to the authorized capital of a Ukrainian company, and not to the investment account of a foreigner.
Lawyers of Armadum Lawyers submitted to the court substantiated written explanations about the illegality of actions of employees of the Central Interregional Department of the State Migration Service in Kyiv and Kyiv region, proving that the money came from a citizen of the Republic of Azerbaijan to the economy of Ukraine. Also, our lawyers have proved that the legislation of Ukraine does not clearly establish the obligation that in order to obtain an immigration permit funds must be transferred directly to the investment account, as well as does not establish that their non-transfer to such account is grounds for refusal such permission.
As a result of timely and coordinated actions in court, the above-mentioned illegal decision was revoked. The court, in turn, ordered the Central Interregional Department of the State Migration Service in Kyiv and Kyiv region to reconsider the application for an immigration permit to Ukraine to a citizen of the Republic of Azerbaijan.
